Conditions d'Utilisation Générales françaises

Ces Conditions d'Utilisation Générales (CuG) sont une traduction française des allemands "Allgemeine Geschäftsbedingungen für die Nutzung von StudiCafé" (AGB). Toute la diligence a été prise pour traduire les AGB de l'Allemand vers le français. S'il devrait y avoir une incohérence entre le texte allemand et le texte français, l'allemand AGB prévalent.

Préamble

Bienvenue sur le StudiCafé, un site Web interactif et un réseau social, qui est disponible sur l'Internet par diverses domaines web. Il peut être retiré par personnes différentes (ci-après dénommé "Utilisateurs", mais également adressée informellement avec «Tu» ou «Ton») et comprend une réseau (ci-après appelé "StudiCafé", "service", "la réseau StudiCafé" ou "réseau"), avec lequel les utilisateurs enregistrés peuvent créer des profils personnels pour d'obtenir ou cultiver des amitiés, rester en contact ou prendre contact avec des gens et communiquer avec des autres. Le StudiCafé est opéré par la   (ci-après appelé "opérateur", ou, en façon plus informelle «nous», voie les méntions legals pour plus de détails). Les utilisateurs enregistrés peuvent publier des informations, créer ou rejoindre des groupes, inviter des amis au réseau, rechercher des personnes dans l'réseau et utiliser d'autres fonctions, des services ou d'applications du réseau.

Avec ces conditions d'utilisations générales, un contrat légale est établissé, qui contiens des informations importantes sur l'utilisation du StudiCafé, tes droits, obligations et informations légales. En les approuver, tu déclares avoir lu, comprendre et accepter d'être lié par les conditions d'utilisations générales et les lois en vigueur. Si tu ne souhaites pas toi conformer aux conditions d'utilisations générales, veuilles ne pas t'inscrire ou ne plus utiliser ou accéder au Service ou au Site.

1. Validité

1.1. Buts

Nous offrons l'accès au réseau et l'utilisation du réseau sur la base de ces conditions générales d'utilisation („CUGs“). En ce qui concerne le rapport entre l'opérateur et la personne utilisant (sera dénommé utilisateur dans ce qui suit), les conditions générales d'utilisation suivantes s'appliquent. Des conditions divergentes de la part de l'utilisateur, qui contredisent les présentes CUG, ne seront pas prises en considération.

1.2. Area of Validity of the ToU & Cs

Les CUGs sont valides pour tous contenus et d'autres services (ci-après aussi dénommé „functions“ ou „applications“), qui sont offrit sur le StudiCafé. Dans le cadre de la relation contractuelle entre l'opérateur et l'utilisateur, les CUGs resteront valides même en cas de recours à d'autres services, qui ne sont pas explicitement rattaché aux conditions d'utilisation.

1.3. Conditions additionelles et réstrictions

Pour certains services, tu peut-être est notifié de pouvoir de télécharger des logiciels ou du contenu et/ou accepter des autres conditions d'utilisation (abrégé ci-dessous comme "aCU"). Dans ce cas, nous en aviserons les utilisateurs de la nécessité de convenir à ces aCU précocement. L'utilisation des services du réseau - en particulier à ceux pour qu'ils faut accepter des aCU - peut-être sera limité à certains utilisateurs et/ou groupes d'utilisateurs.

1.4. Modifications des CUG

Nous nous réservons le droit de modifier les conditions d'utilisation à tout moment, sans donner de raison, en étant soumis à la exigences énoncées en vertu des articles 1.5 et 10.1.3. Dans ce cas, les nouveaux CUG entrent en vigueur comme ils sont publiées sur cette page. En cas des modifications fondamentales, nous serons informé de ces modifications par e-mail, deux semaines avant leur entrée en vigueur. En ce cas, tu peux réjeter des conditions nouvelles au cours des deux semaines. Si tu ne pas exprimes ton désaccord quant à ces nouvelles conditions au cours des deux semaines à compter de la date d'envoi du mail, celles-ci seront considérées comme approuvées. L'opérateur rappellera à l'utilisateur la mise en place de ce délai dans le mail où figureront les nouvelles conditions d'utilisation.

1.5. Termination du contrat, Le droit d'exprimer désaccord

Si tu exprimes ton désaccord quant à ces nouvelles conditions au cours des deux semaines, nous nous reservons le droit de terminer le contrat au cours des deux semaines.

2. Utilisation du StudiCafé

2.1. S'inscrire

Pour pouvoir utiliser le StudiCafé en toutes les fonctionnalités, il faut d'un inscrption. En concludant l'inscription avec succès, un compte est crée (ci-après denomée comme „Ton compte“).

2.1.1. Pour créer un compte avec succès, nou To successfully create an account, nous avons besoin de certaines informations concernant de toi. Ces informations comprennent ton nom complet, ton sexe, ton adresse E-mail, et un mot de passe que tu peux choisir. En donner ces informations, tu affirmes les-quels d'être corrects, complets et vrais. Utiliser des pseudonymes ou noms fictifs n'est pas permis. Créer un compte avec un nom incorrecte ou se faire passer pour quelqu'un d'autre est aussi permis.

2.1.2. Nous envoions un E-mail à l'adresse fournie par toi au moment de l'inscription, afin de confirmer la réception des données transmises lors de l'incsription. L'enregistrement ne sera pas réussi jusqu'à ce que tu confirmes ton inscription en cliquant sur le lien d'activation dans le cette E-mail. L'accord/contrat entre toi et nous n'entres pas en vigueur jusqu'à ce que l'utilisateur a suivi ce lien d'activation. Le contrat est conclu dès que l'utilisateur s'est inscrit avec succès sur StudiCafé.

2.1.3. Le StudiCafé est destiné qu'à un usage privé. L'utilisation pour le but commercial est interdit. En s'inscrivant, tu t'engage à utiliser le StudiCafé seulement pour des buts privés.

2.1.4. Si l'inscrition n'est pas complet, nous supprimons le compte et tous les détails de toi après sept jours.

2.1.5. Personne ne peut revendiquer un droit de conclure une entente à utiliser le réseau. Nous pouvons refuser une personne d'enregistrement sans indication de motifs. Dans ce cas, nous allons supprimer les données envoyées par l'utilisateur sur le formulaire d'inscription.

2.2. Réquisitions pour s'inscrire

2.2.1. Tu peux seulement t'inscrire en étant une personne habilitée en droit.

2.2.2. Tu garantis à l'opérateur d'avoir plus de 18 ans. Seulement des adultes peuvent s'sinscrire sur le réseau. Nous avons le droit de vérifier ton identité, notamment en lui réclamant des papiers d'identité administratifs, et nous réservons le droit de supprimer le compte d'un utilisateur sans donner aucune raison.

2.2.3. Tu peux seulement t'inscrire une fois. En s'inscrivant, tu affirmes que tu'est déja inscrit sur le StudiCafé.

2.2.4. Tu affirmes que tous les informations donnée par toi sont corrects et vrais (et décrivent seulement toi et rien d'autre). C'est aussi valide pour photos de toi.

2.3. Après l'inscription

2.3.1. En l'enregistrement est réussi, tu peux accéder au réseau du StudiCafé. L'adresse e-mail et mot de passe stipulé par toi doit être entré dans l'ordre pour te connecter.

2.3.2. Ton mot de passe (que tu as choisis en enscrivant) doit être gardé confidentialement et ne soit pas passé a quelqu'un d'autre. Nous t'encourageons à modifier ton mot de passe immédiatement s'il ya des raisons de soupçonner les autres d'abuser ton compte. Il est de ton devoir de garder tes détails pour connecter confidentiel, en particulier ton mot de passe. Tu es responsable de ton compte. De plus, tu assures de ne jamais permettre à d'autres l'accès du StudiCafé par l'intermédiaire de ton compte (par exemple en passant ton mot de passe aux autres personnes). Quand à toi, tu es interdit d'abuser autres comptes pour obtenir l'accès au StudiCafé.

2.3.4. Tu t'engages à immédiatement enregistrer les modifications ultérieures de tes données d'accès (en particulier ton adresse e-mail) dans les paramètres de ton compte. Ces modifications peuvent être faites en allant dans "ton profil" ou "Ton compte" et en cliquant sur "modifier".

en particulier celles concernant les données fournies par les utilisateurs ou concernant le contenu des commentaires produits par ceux-ci. L'opérateur n'est pas responsable des éventuels détournements d'information.

2.3.5. L'identification des personnes sur l'Internet est seul possible dans une certaine mesure. Pour cette raison, nous ne pouvons pas complètement exclure la possibilité que les coordonnées inexactes sont saisies lors de l'enregistrement. Nous ne garantissons pas la véritable identité de touts utilisateurs. Les utilisateurs doivent s'assurer de l'identité d'autres utilisateurs.

2.4. Désinscription et supprimation du compte

2.4.1. Si tu ne veux plus utiliser le réseau, tu peux résilier le contrat à tous les moments, sans indication de motifs, et sans délais. Pour supprimer ton compte, clicque sur „Ton compte“ and après sur „Supprimer ton compte“. C'est aussi possible en envoyant une lettre ou en envoyant un mail, en donnant l'adresse E-mail que tu as utilisé pour l'accès du réseau, et des copies des documents officiels pour vérifier l'identité.

2.4.2. Nous pouvons également terminer le contract à tout moment en donnant 14 jours de préavis à la fin du mois. Ce qui précède n'affecte pas le droit de mettre fin à une bonne cause ou le droit de bloquer l'accès d'un utilisateur.

2.4.3. En se désinscrivant, toutes les données sauvegardées concernant le profil du membre seront supprimées. Seulement des contributions faits en public (par example dans un groupe) restent dans notre base de donées, mais le nom et l'image du profil n'apparaissent plus, et avec un renseignement que l'utilisateur qui as écrit ce contribution as terminé son compte. En plus, les groupes fondés par toi ne seront pas supprimés. Pour ces groupes, un des membres du group devrait le nouveau fondateur.

2.4.4. La relation contractuelle prendra ainsi fin en désinscriotion. La validité des CUG prévale.

2.5. Costs

L'inscription à StudiCafé est gratuite. Aussi, tous les services, applications et functions du StudiCafé sont rgratuits. Nous nous réservons le droit de gagner des revenus par réclame décente et non-personnalisée, sponsoring et donations afin d'assurer l'existence du StudiCafé.

3. Sujet de contrat et services

3.1. Services et Applications

Sur le StudiCafé, tu peux utiliser des applications et services. Parmi d'autres, il y a:

1. profils („Ton profil“) et applications similares pour télécharger donées et contenu (p.e. textes, images, vidéos), qui peux être regardé par tous utilisateurs ou groupes d'utilisateurs du réseau;
2. Applications pour communiquer avec autres personnes (p.e. envoyer des messages, envoyer des actions, inviter qn à rejoindre un groupe ou une discussion de Chat);
3. Une application pour chercher autres personnes dans le réseau;
4. Applications pour présenter ou publier textes, images ou contenu audiovisuel (vidéos/musique), ci-après dénommé simplement „Contenu“), comme albums photo personels ou blogs;
5. Applications pour fonder, administrer et utiliser des groupes dans le réseau.

3.2. Buts du StudiCafé

StudiCafé est particulièrement destinée à rassembler les gens et de leur donner la possibilité de communiquer les uns avec les autres, tout en ayant du plaisir et la jouissance. Par conséquent, nous fournissons l'infrastructure technique (applications et fonctions), mais, toutefois en termes de contenu, nous ne sommes pas impliqués dans la communication entre les utilisateurs.

3.3. Upgrades or restrictions to applications, new applications

Nous sommes naturellement efforcé d'améliorer et de moderniser le StudiCafé. Dans le cadre, le réseau et les applications peut être amélioré et / ou mis à niveau, ou hors service. Dans ce contexte, il peut parfois être nécessaire de limiter temporairement les services du réseau, par exemple en ce qui concerne les limites de capacité, de sécurité du réseau, et de l'intégrité des serveurs, ou pour effectuer la maintenance technique. StudiCafe vas examiner les intérêts des utilisateurs et, par exemple, annoncer des travaux de maintenance en avance sur le site.

3.4. Users' claims

The right to use the Network and the Applications is limited to what state-of-the-art technology allows. The maximum storage space for users' contents is currently not limited, but such a limit can become necessary at any time, especially in regards to frictionless service of the StudiCafé. We therefore reserve the right to put such limits or restrictions into force.

3.5. External content

We will notify users via the Network of things such as third party content and Applications (hereinafter „Third Party Content“), including, without limitation, by means of so-called hyperlinks. Such Third Party Content is identifiable by a reference to this effect (e.g. „Advertisement“ or „This is an offer by [name of third party]“). If and to the extent that an offer is made to users to enter into a contract in connection with such Third Party Content, such a contract is formed exclusively with the party responsible for the content and named as provider.

4. Users' oblogations

To provide use, fun and relaxed communication to you at the greatest extent possible, the following section contains some obligations and rules, all users have have to abide by.

4.1. Your responsibility regarding your Account's contents

You are responsible for the contents of your account and thereby for all information you provide about yourself. It is therefore the user's responsibility to ensure that the respective content is lawful, and above all does not contravene any laws or infringe any third party rights (particularly personality rights or the intellectual property of others). You furthermore affirm that all your personal information is correct and true and only describe your personality.

4.2. Prohibition of commercial usage by users

You affirm that by using the Network you have no aims to do so for trade or business purposes or in any other commercial manner. All data obtained within the Network concerning others must not be used in commercial context, including advertising purposes. A usage is only permitted for private purpose. Using the Network, its Applications or Contents in any other manner is strictly prohibited.

4.3. Use of the content within the Network

All Contents (particularly pictures, videos, music and texts) must, apart from the statutory exceptions, may not be copied, disseminated or otherwise published without the consent of the respective proprietor. Insofar it is prohibited to make availabe or to spread contents, if doing so is unlawful, infringing any third party rights or offending against good manners.
When publishing contents as defined above, the following complementary rules must be abided by:

1. Contents depicting violence and/or containing any sexual, discriminatory, offensive, racist, defamatory or other unlawful purport or references are strictly prohibited.
2. Also prohibited are pictures which exclusively show or include company logos, trademarks or other commercial emblems or other protected marks.
3. On pictures published via the Photo Application, you can tag other people you are friends with in the Network. On the other hand, people you are friends with, can do so with you. You can object to being tagged on photos completely by adjusting your Privacy Settings at the „Your Account“ section.
4. After uploading or publishing contents, they may be removed or replaced at any time with prospective effect by the user who uploaded the file, except for contents published in public groups' forums.
5. Furthermore, you are not allowed to set hyperlinks to other websites containing unlawful and/or X-rated contents. Also, links to illegal computer software, websites containing instructions for removing copy protections or illegaly distributing music are prohibited.

4.4. Code of Conduct

The code of conduct for use of the Network, which is binding on all users, must be observed. It contains several rules for good behaviour of our users and for contents published by the users (for e.g. in profiles, blogs, albums or groups) and the handling of contents obtained during the usage of StudiCafé.

4.5. Prohibition of disruptive attacks

To ensure a frictionless service of the StudiCafé, disruptive action or attacks on the Network are prohibited. Particularly the following, additional regula

von dem Willen beseelt, als freie Plattform in einem vereinten Europa dem Nutzen der Mitglieder zu dienen,
hat sich das StudiCafé kraft seiner Verhaltensregeln-gebenden Gewalt diese Verhaltensregeln gegeben.

Die Nutzer können in freier Selbstbestimmung einer freien, demokratischen und nichtkommerziellen Plattform beitreten. Damit gelten die folgenden Verhaltensregeln für Dich, den Betreiber und alle anderen Nutzer.

1. Die Würde eines jeden Mitglieds ist unantastbar. Die Regeln der Netiquette zu achten und zu schützen ist Aufgabe aller Mitglieder und des Betreibers. Diese beinhalten eine respektvolle Ausdrucksweise und einen höflichen Umgang miteinander.
2. Alle Mitglieder haben das Recht auf freie Entfaltung ihrer Persönlichkeit. Hierbei dürfen jedoch nicht die Rechte anderer verletzt oder gegen das Sittengesetz verstoßen werden. Daher sind Beleidigungen, negatives Hervorstellen anderer Nutzer oder schlechte Umgangsformen auf dieser Plattform unerwünscht.
3. Alle Mitglieder sind vor den Nutzungsbedingungen oder den Verhaltensregeln gleichberechtigt. Niemand darf wegen seines Geschlechts, seiner Abstammung, seiner Rasse, seiner Sprache, seiner Heimat und Herkunft, seines Glaubens, seiner Sexualität, seiner religiösen oder politischen Anschauung oder seiner Behinderung benachteiligt oder bevorzugt werden. Jedoch sind rassistische, politisch extremistische, gewaltverherrlichende, diskriminierende, sexistische, oder sonst anstößige Veröffentlichungen, sowie solche, die andere Personen, Volksgruppen oder religiöse Bekenntnisse verleumden, beleidigen, verbal herabsetzen oder bedrohen, nicht gestattet.
4. Jedes Mitglied hat das Recht, seine Meinung in Wort, Schrift und Bild frei zu äußern und zu verbreiten und sich aus allgemein zugänglichen Quellen ungehindert zu unterrichten. Die Freiheit der Inhaltsgestaltung wird unter Berücksichtigung der Nutzungsbedingungen gewährleistet, eine Zensur findet nicht statt.
5. Das Fernmeldegeheimnis und die Datenschutzbestimmungen sind unverletzlich. Ebenso sind die persönlichen Daten unantastbar. Durch den Zugriff auf das StudiCafé erlangte Daten und Informationen dürfen nicht ohne die Zustimmung des jeweiligen Nutzers veröffentlicht oder weiterverwendet werden. Derartige Informationen dürfen lediglich zu Zwecken der eigenen privaten Kommunikation benutzt werden. Insbesondere Arbeitgebern, Ausbildungsbetrieben, Personal- und Arbeitsvermittlern, Universitäten, Fachhochschulen und anderen Bildungseinrichtungen ist die Verwendung persönlicher Daten zur Personaldatenerhebung oder Beurteilung von Personen strengstens untersagt.
6. Alle Mitglieder genießen Freizügigkeit auf der gesamten Plattform. Dieses Recht findet ausschließlich Einschränkung durch die geltenden Gesetze und die in den Nutzungsbedingungen formulierten Bestimmungen. Insbesondere müssen Angaben in Profilen und Gruppen der Wirklichkeit entsprechen. Jedes Vortäuschen einer fremden Identität ist untersagt. Sämtliche Inhalte in Profilen und Gruppen, sowie Bilder und Links sind lediglich privaten Zwecken vorbehalten. Eine Veröffentlichung zu kommerziellen Zwecken ist verboten.
7. Inhalte von Nutzern sind vertraulich zu behandeln. Sie dürfen nur mit ausdrücklicher Zustimmung des Absenders Dritten zugänglich gemacht werden.
8. Jedes Mitglied hat das Recht, sich einzeln oder in Gemeinschaft mit Anderen mit Bitten oder Beschwerden an uns zu wenden.
9. Kettenbriefe, Pyramidenschemata, Wettbewerbe, Lotterien, Wettspiele oder Ähnliches dürfen nicht über das StudiCafé-Netzwerk verschickt bzw. organisiert werden. Es darf generell keine Werbung von Nutzern veröffentlicht werden.
10. Für jede Art von Veröffentlichung (Daten, Informationen, Bilder und dergleichen), sowie deren Folgen sind die Nutzer in jeder Hinsicht selbst verantwortlich. Die Rechte Dritter (Copyright, Bildrechte etc.) sind zu berücksichtigen. Der Nutzer darf daher nur Inhalte veröffentlichen, an denen er auch die Rechte hält. Für Veröffentlichungen mit Bezug zu Dritten ist deren Einverständnis erforderlich. Das Recht am eigenen Bild gilt grundsätzlich.
11. Technische Angriffe, um Daten einzelner Nutzer ganz oder teilweise zu verändern, zu missbrauchen, zu löschen oder in sonstiger Weise zu beschädigen, sind untersagt. Dies gilt generell für alle technischen Komponenten (insbes. Hard- und Software, Server, etc.) von StudiCafé und deren Anwendungen. Ferner dürfen Daten nicht ohne Zustimmung manuell oder automatisiert (wie u.a. durch Crawler, Spider oder Robots bzw. Bots) zum Zwecke der Datengewinnung ausgelesen, gespeichert, bearbeitet, verändert, weitergeleitet, kommerziell genutzt oder auf sonstige Weise missbraucht werden.
12. Es dürfen keine Viren, Links, Programme oder sonstige Verfahren angewandt oder verbreitet werden, mit denen gegen die Nutzungsbedingungen von StudiCafé verstoßen wird.
13. Die Bekanntgabe und der Austausch von Passwörtern, Codes und Seriennummern jeglicher Art sind auf der Plattform nicht gestattet.
14. Wer gegen die Nutzungsbedingungen oder die Verhaltensregeln verstößt, muss mit Sanktionen oder einem Ausschluß von der Plattform rechnen. Dies gilt insbesondere bei Verstößen gegen geltende Gesetze oder Belästigungen (insbesondere durch „Mobbing“, „Stalking“ bzw. massenhaftes Versenden von Nachrichten oder Durchführen von Aktionen) anderer Mitglieder. Näheres regeln die Nutzungsbedingungen (siehe Paragraph …).
15. Wir erachten die Tatsache für selbstverständlich, dass alle Nutzer gleich sind und sie von ihrem Schöpfer mit gewissen unveräußerlichen Rechten ausgestattet wurden, unter diesen sind Leben, Freiheit und das Streben nach Glück.

/strong> It is prohibited, without limitation, to take action to send unsolicited mails and/or advertisements (e.g. mass mail-outs [spam]) or to cause unreasonable inconvenience to other users.

4.5.2. Electronic attacks of any kind on the Network (including all hardware and software used to operate the Network) or on individual users are prohibited. Such electronic attacks include inter alia the following:

• hacking attempts, i.e. attempts to overcome, circumvent or otherwise decommission the Network's security mechanisms;
• the use and/or dissemination of viruses, worms or Trojan horses;
• and brute force attacks.

4.5.3. The use of computer programs to automatically collect information, e.g. crawlers (also known as spiders or robots, "bot" for short) is also prohibited.

4.5.4. Other actions or procedures which could disrupt or cause damage to the Network, its Operator, and/or its users are strictly prohibited.

4.6. Backing up your own data

To advance your own security or the security of your data, you are under an obligation to take reasonable precautions to back up information which can be viewed via the Network and which is stored by   (e.g. messages within the messaging service) using current back-up technology. It is therefore your responsibility to save and/or print out important information on your own equipment – preferably at the end of each Network session – to ensure unrestricted access to the data independently of the Network.

5. Sanctions and other consequences in the event of user violations

In general, we strive to avoid contention or disputes among the users („conflicts“), violations against the Terms Of Use or the Code of Conduct, unlawful action, infringments against third party rights or against good manners.

5.1. Report function

The „Report“-function allows you to report contentious or obnoxious contents (or such violating our Terms Of Use) and to resolve the underlying conflicts without having others or yourself imposed a sanction. Its usage is documented below:

5.1.1. In general, you can report other users, groups, advertisements, harassment or obnoxious contents (text, pictures, videos, music etc.), if you provide details about your report including your reasons to do so anonymously.

5.1.2. After you reported something, the user to be held responsible for the disputive contents gets notified about the report, containing your details and reasons. It is anonymous, and allows him to remove or adjust the reported contents within a certain timespan, and to react with a brief message to give feedback about the report. At no time the responsible user is informed about your identity.

5.1.3. You will get the feedback of the responsible user after that step, and you can again asess if the violation or obnoxious content is still available or has been conformed appropriately. If you think so, conflict is considered resolved, and no sanction is imposed. If no reaction of the responsible user goes back to you, or the conflict remains in any way, you can redirect your report to us, the operator of StudiCafé. In this case, we will check the report and take action and/or impose sanctions appropriately.

5.1.4. You also have the possibility to use the „Report“-function to address the conflict to us, the operator, directly (and not to allow the responsible the possibility to react first). We only recommend doing so in very severe cases.

5.2. Preservation of the Operator's rights

In the case of a violation of our Terms Of Use by yourself or other users, against current laws or the good manners, we preserve the following rights:

• The right to exclude the user from the Service without notice (and/or to demand indemnification),
• the right to delete the user accound including all personal data permanently and completely,
• the right to cancel the agreement without notice,
• and/or the to impose other sanctions on the user.

Initiation of proceedings by civil law and/or criminal proceedings, in particular the claim for damages and/or the repayment of a criminal complaint remain in such cases explicitly reserved.

5.3. Possible sanctions in the event of user violations

In deciding which sanction to impose, we will take into account the legitimate interests of the user and will consider, among other things, whether the case involves accidental misconduct or a deliberate violation. Possible responses may include the following actions and sanctions:

• wholly or partially deleting a user's content from the Network
• issuing a warning to the user;
• temporarily blocking a user from the Network;
• permanently blocking a user from the Network.

5.4. Right, to remove incriminated contents

We reserve the right to inhibit or to remove incriminated contents (pictures, music, videos, Texts, etc.) oder tags without preadvice or without issuing a warning. This particularly holds for profiles/accounts reflecting other than the real identity of a user and for groups violating the Terms Of Use in a severe manner.

5.5. Exclusion of users, prohibition of re-registering

If a user is blocked, he or she is prohibited from continuing to use the StudiCafé. In addition, a blocked user will be prohibited from re-registering at the StudiCafé.

6. Penalty scheme („Vertragsstrafenregelung“)

The safety of the users' data has top priorty to us. We implemented certain security mechanisms and want to reserve the following rights to even advance the users' safety.

The user undertakes for every case of culpable violation of the prohibition of electronic attacks and the automatic extraction of data (in particular paragraphs 4.6.2. and 4.6.3.) to pay a sum of money of at least EUR 5.000,00 (in words: five thousand Euro, fixed by reasonable descretion by the operator and to be validated by a District Court) on the first request to the operator. Furthermore, in such cases the user undertakes to provide a usual negative covenant declaration (which follows after legal standards and is depending on the individual case), on the first request to the operator, containing the following statements:

• To forborne the electronic attack instantly and not to organize or commit such electronic attacks in future,
• to forborne to distribute or to relinquish data obtained during the attack to third parties,
• to inform the operator instantly about possible security holes or flaws which the user know of and which were possibly used during the attack,
• to inform the operator instantly about all third parties having obtained data material (regarding the attack) by the user,
• to undertake permanent deletion of all data material obtained during the attack and/or to return such material to the operator,
• to provide a declaration under oath as confirmation of the deletion of such data material to the operator,
• to maintain silence (in public) for at least two weeks after noticing possible security holes, to provide a facility to the operator to fix the security holes or software errors (if any).   

7. Indemnification by the user

The user indemnifies   against any and all claims made by third parties against   based on the infringement of such third party's rights, if the claims arise as a result of the content uploaded to the Network by the user or through any other use of the Applications available over the Network by the user. The user will bear the costs of any reasonable legal defence of  , including all court costs and attorneys fees based on the statutory fee schedules. The foregoing does not apply if the infringement of rights is not attributable to any intentional behaviour or negligence on the part of the user. If a third party raises a claim against  , the user shall furnish   promptly, truthfully and completely with all information available to the user which is necessary in order to assess the claims and for a defence against them. The foregoing does not affect any further damage claims available to   against the user.

8. Limited Liability of the Operator (Gewährleistungsausschluß)

8.1. Liability of the operator

The operator is liable for:

1. For damage arising as a result of injury to life, limb or health, damage caused by the wilful or negligent breach of duty and for other damage caused by any wilful or grossly negligent breach of duty or fraudulent intent,   is liable to users in accordance with the relevant statutory provisions.
2. In addition,   is liable for damage covered by mandatory statutory provisions such as the German Product Liability Act (Produkthaftungsgesetz) or damage caused by the breach of representations or warranties made by  .
3. In the case of loss or damage not covered by section (8.1) which is caused by intentional behaviour or by the negligence of  ’s legal representatives, executives or other vicarious agents (“Erfüllungsgehilfen”),  ’s liability is limited to typically foreseeable loss or damage.

In all other cases the operater's liability is excluded.

8.2. Limited liabiliy for contents

The law does not require   as a service provider to monitor the information transmitted or saved via the Network or to investigate circumstances that indicate unlawful conduct. However, if   becomes aware of unlawful conduct on the part of a user or unlawful information within the Network, this information will be deleted without undue delay or access to such information will be blocked.

8.3. Limited liability due to technical problems

The operator is not liable for problems or technical difficulties concerning telephone networks, -lines, online system, servers or providers, computer hardware, software, as well as for failures or losses of emails, video players due to technical problems, router overflows in the interne and/or the StudiCafé Network or a combination from it. The operator does not bear responsibility for errors, omissions, interruptions, deletions, defects or delays concerning the operation or transmission, breakdown of communication lines, as well as unauthorized access, data theft, destruction or alteration of data saved in the databases and/or on servers operated by the  .

The StudiCafe Network is provided as-is, without any warrenty covering shortcomings. The operator takes no warranties in that the applications of the Network are available at any time, in-time, secure and without errors or interruptions.

8.3. Limited liability concerning hyperlinks

The Hamburg regional court in May 1998 decided that by linking to other websites, the linking site can be held responsible for the contents of the linked site. This can only be prevented by an explicit distancing from the content of a linked site. We do have links to other websites on our website. For all these links placed on our website the following holds: We hereby dissociate ourselves expressly from all contents of linked site and the links included in such content.

9. Privacy

The safety of your personal data Die Sicherheit der persönlichen Daten der Nutzer des StudiCafé hat oberste Priorität! Der größtmögliche Schutz durch Einhaltung gesetzlicher Datenschutzbestimmungen und die Umsetzung technischer Sicherheitsmaßnahmen ist uns ein sehr ernstes Anliegen. Die Nutzung vom StudiCafe Netzwerk unterliegt daher zudem unseren Datenschutzrichtlinien, die zu Referenzwecken in diese Nutzungsbedingungen eingebunden sind.

10. Final provisions and miscellanous

10.1. Clause de préservation

Si un réglement du contrat ou l'ensemble des conditions d'utilisation s'avéraient nulles, ou si le contrat s'avérait incomplet, cela n'affecterait en rien la validité desdites clauses du contrats ou de l'ensemble des conditions d'utilisation. Le réglement nul est considéré comme remplacé par un réglement, tel qu'il jouisse d'un bon sens économique et soit juridiquement valable. Il en va de même pour d'éventuelles lacunes dans le contrat.

10.2. Juridiction et droit applicable

Le droit applicable est celui de la République fédérale d'Allemagne, en excludant la Convention des Nations unies sur les contrats de vente internationale de marchandises. Cela s'applique à tous conditons, ainsi qu'à tous les stipultations futurs.

Si applicable, courte competents est lequel de Freiburg im Breisgau.

10.3. Cancellation policy
